The Gazzaz website www.gazzaz.com.sa is accessible via the Internet and will soon be available through mobile applications.

The content and services available on the Site are provided to you subject to these Terms and Conditions, our Privacy Policy, and any other terms and policies you may find on the Site relating to specific functions, features, offers, or customer services. All of these form part of these Terms and Conditions (“General Conditions”).

By accessing the Site or the Application, you acknowledge that you have read, understood, and agreed to these Terms and Conditions, and you agree to be bound by them unconditionally.

Intellectual Property

We grant you a personal, non-exclusive, non-transferable, and revocable license to use the software we provide as part of the Website, solely to enable you to use and enjoy our Services as set out by us and as permitted under these Terms and Conditions.

Commercial use, or use on behalf of any third party, is prohibited unless expressly permitted in writing in advance. Any breach of these Terms and Conditions will result in the immediate termination of the license granted under this section, without notice and without prejudice to any of our other rights.

All copyrights, trademarks, trade names, trade dress, designs, website features, and any other form of intellectual property, materials, and rights associated with the Site, including software, HTML and other code, page and image titles, text, illustrations, formats, logos, icons, images, music, downloads, and videos (collectively, “Intellectual Property”), are and shall remain at all times the sole property of GAZZAZ and/or its licensors, and are protected by the laws of the Kingdom of Saudi Arabia and international trademark and copyright laws.

Intellectual Property and other materials displayed on our Website may be accessed, viewed, downloaded, and printed solely for personal, non-commercial use, as expressly authorized by Gazzaz and/or its third-party licensors, provided that:

No modification or alteration of the Intellectual Property is made in any way; and
The Intellectual Property is not provided or made available to any third party for commercial purposes.

No copyright, trademark, or other proprietary right is acquired in relation to the Intellectual Property. Your use of this Website, or your access to, viewing, downloading, or printing of the Intellectual Property, does not grant you any license, right, or interest in any materials or software.

You may not copy, distribute, broadcast, display, modify, create derivative works from, sell, or otherwise exploit any Intellectual Property or any material from our Website, in whole or in part. The Intellectual Property may be used only as a shopping resource. Any other use, including copying, editing, distribution, transmission, republication, display, or performance, is strictly prohibited.

Gazzaz is the sole owner or exclusive licensee (as applicable) of the Intellectual Property and is the exclusive licensee of the domain name www.gazzaz.com.sa.

Third-Party Content and Websites

Gazzaz may provide content owned by third parties (“Third-Party Content”) or links to third-party websites (“Third-Party Websites”) as a service to those interested in such information. Gazzaz does not monitor, control, or endorse any Third-Party Content or Third-Party Websites. The inclusion of such content or links does not imply any association or relationship between Gazzaz and the relevant third parties.

Gazzaz does not guarantee the accuracy or completeness of any Third-Party Content or Third-Party Websites, and is not responsible for updating or reviewing them. Your use of Third-Party Content and Third-Party Websites is at your own risk. Third-Party Content, including comments from users, does not necessarily reflect the views of Gazzaz.

Accordingly, Gazzaz shall not be liable, for any reason whatsoever, for any Third-Party Content and/or Third-Party Websites, including but not limited to external sources, content, advertisements, products, services, or any other information or data made available on the Website or from external sources.

Terms of Sale

1. Eligibility

Purchasing products through the Website is limited exclusively to persons who are legally able to enter into contracts online under the laws of the Kingdom of Saudi Arabia.

To make purchases on the Website, you must provide your personal details, including your full real name, a valid mobile number, a valid email address, payment details, a valid billing address, and any other required information. You confirm and warrant that the payment details you provide are valid, complete, and correct, and that you are the person named in the billing information provided.

The Website is available only to persons who meet the eligibility requirements and hold a valid payment method accepted by Gazzaz, and who authorize us to charge the total value of the products purchased, including any applicable taxes or delivery charges. Products are purchased for personal use or as gifts only, and may not be resold or used for any commercial purpose or gain. Gazzaz reserves the right to limit the quantity of any item shipped to a single customer or address.

When you place an order, you expressly authorize Gazzaz to verify your payment card and to exchange your card information or credit information (including any updates) with third parties in order to verify your identity, confirm the validity of your card, and obtain authorization for your purchases, as we deem necessary. You agree that we may use the personal information you provide to carry out the necessary fraud-prevention checks, and that such information may be disclosed to a credit reference or fraud-prevention agency, which may keep a record of it.

2. Ordering Products

Products available on the Website, including any samples or free gifts offered with purchases, are for personal use or as gifts only. You may not sell or resell any products purchased or otherwise obtained from Gazzaz.

All products are subject to acceptance and availability. If, for any reason, we are unable to supply a product, we will notify you as soon as possible and cancel your order in full.

Please note that you may order a maximum of 10 units of any single product.

All orders are subject to acceptance. We reserve the right to refuse or cancel any order for any reason, including inaccuracies or errors in product or pricing information, failure to obtain payment authorization, delivery restrictions applicable to a particular item, the item failing to meet our quality control standards and being withdrawn, your failure to meet the eligibility criteria set out in these Terms and Conditions, or any other issue we identify.

Gazzaz will keep a record of your transactions for a minimum of ten years.

Once your order is placed, you will receive an email with your order details. This email does not constitute acceptance of your order; it only confirms that we have received it.

One of our representatives will contact you to confirm your order. If our representative is unable to reach you on the number you provided, you will receive an email asking you to confirm your order. Your order may still be processed even if no confirmation is received.

Unless you cancel your order, it will be accepted once we have completed processing it, and you will receive a second email confirming that your order has been accepted and shipped. The sale contract is concluded in the Kingdom of Saudi Arabia at the moment of acceptance, and the language of the contract shall be Arabic. Neither the third-party payment processor nor the carrier we appoint is authorized to accept an order on behalf of Gazzaz.

We may refuse to process any transaction, or refuse delivery to any person, at any time at our sole and absolute discretion. We shall not be liable to you or any third party for withdrawing any product (including samples or gifts) from the Website, whether or not it has been sold; for removing, reviewing, or editing any material or content on the Website; for refusing to process a transaction; or for cancelling or suspending any transaction after processing has begun.

We make every effort to ensure that all details on the Website are accurate, but pricing errors may occasionally occur. If we discover a pricing error affecting your order, we will notify you as soon as possible. We are not obliged to accept or fulfil an order for a product advertised at an incorrect price, and we reserve the right to cancel such an order even if it has already been accepted or shipped. In that case, we will contact you by email or phone to inform you that your order has not been accepted and/or has been cancelled. If you have already paid, we will refund the full amount as soon as possible. If the products have already been shipped, the refund will be processed once we receive them back.

By confirming your purchase at the end of the checkout process, you agree to pay the full amount due for the product(s) in your order, including any applicable delivery charges.

3. Prices and Payment

All prices include the Value Added Tax (VAT) applicable on the date of your order. Any change in the applicable VAT rate will be automatically reflected in the prices of products sold by Gazzaz through its Website.

All card payments are subject to validation and authorization by the card issuer. If the issuer declines authorization, we shall not be responsible for any delay or non-delivery, and we will cancel your order and may contact you to arrange an alternative payment method.

The details of the card used for payment must exactly match the cardholder’s information registered with the card issuer. Payment will be authorized and held when you place your order, and the amount will be charged once your order is processed. You confirm that the card used is your own, or that you have been expressly authorized by the cardholder to use it.

No card data will be stored, sold, shared, or leased to any third party, except the online payment gateway provider we use.

4. Delivery

We deliver within the Kingdom of Saudi Arabia. Orders are expected to arrive within 3 to 7 business days from the date your order is confirmed by email, depending on your location.

Delivery charges, if any, will be added to the product price and shown separately in your local currency during checkout.

If no one is available to receive the order, you may arrange an alternative delivery date or obtain further information from the delivery company. If the order cannot be delivered on the second attempt, you may be charged an additional delivery fee for each further attempt.

Orders are delivered Saturday to Thursday, excluding Fridays and public holidays.

5. Cancellation, Return, and Exchange Policy

At Gazzaz, our goal is to ensure our customers’ satisfaction with their purchases.

For your safety, Gazzaz does not accept returns or exchanges of its products except in the following two cases only:

The product arrives damaged or defective.
You receive a product different from what you ordered.

How to Return
To return a damaged, defective, or incorrectly shipped product, please contact our customer service by calling 920022644, or by sending an email including your shipment number to customer.service@gazzaz.com.sa.

Return Conditions

Damaged or defective products may be returned within 7 days from the date of receiving the order.
The product must be in the same condition in which it was received, with no change to its shape and no signs of use.
The return process may take up to 10 business days from the date we receive the product.
Refunds for damaged or defective products will be issued once the product reaches us and its condition is verified; the amount will then be transferred to you.

Shipping Costs for Delayed Delivery, Exchanges, and Returns

If a delay in receiving an order, or its return, is caused by the customer for any reason, the customer shall bear the resulting shipping costs.
If the return or exchange is due to a product defect or a product that does not match the order, the company shall bear the full shipping costs at no additional charge to the customer.

Cancellation
We understand that you may sometimes change your mind about a purchase. If you wish to cancel your order before receiving it, simply email our customer service at customer.service@gazzaz.com.sa, and we will make every reasonable effort to cancel it, provided it has not already been shipped. If the order has already been shipped, the cancellation will be treated as a return. In all cases, our customer service team will be happy to assist you.

6. Offers and Discount Coupons

Additional discounts do not apply to products already on offer or discounted. This includes discount coupons, credit card discounts, Apple Pay discounts, Qitaf Tamayouz discounts, or any other discount.

Miscellaneous Provisions

We reserve the right to amend these Terms and Conditions at any time without prior notice. Any amendments take effect as soon as they are published on the Website. Your continued use of the Website (or any of our other websites) after such changes constitutes your acceptance of the amended Terms and Conditions. Please review them regularly. If you do not agree to any changes, you must stop using the Website immediately.

These Terms and Conditions constitute the entire legal agreement between you and Gazzaz, govern your use of the Website and all services and products available through it, and supersede any prior agreements between you and Gazzaz on the same subject.

You acknowledge and agree that the form and nature of the Services may change from time to time without prior notice, and that Gazzaz may stop providing the Services (or any of their features) to you or to users generally.

You acknowledge that Gazzaz permits operators of public search engines to use web crawlers to copy material from the Site solely for the purpose of creating publicly available search indexes, and Gazzaz reserves the right to revoke this permission generally or in specific cases.

You acknowledge that you are solely responsible (and that Gazzaz has no liability to you or any third party) for any breach of your obligations under these Terms and Conditions and for the consequences of any such breach, including any loss or damage you may suffer.

Any failure or delay by Gazzaz in exercising or enforcing any right or remedy shall not be construed as a waiver of that right or remedy.

You and Gazzaz are independent contracting parties. Nothing in these Terms and Conditions creates a partnership, joint venture, franchise, employment, or agency relationship between you and Gazzaz. Neither party has authority to bind the other or act on its behalf without the other party’s prior written consent, nor may either party represent itself as the agent or representative of the other, except as expressly provided in these Terms and Conditions.

If any provision of these Terms and Conditions is found to be unlawful or unenforceable, the remaining provisions shall not be affected and shall remain in full force and effect.

These Terms and Conditions are available in Arabic and English. In the event of any conflict between the two, the Arabic text shall prevail.

These Terms and Conditions are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from them shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Saudi Arabia.
